nelson.social is an online space dedicated to the community of Nelson, BC. Please carefully read our Terms of Use as set out on this page before using this online space. These terms govern your use of the nelson.social online space and by using the nelson.social online space, you agree to be bound by these terms.

About

Welcome to nelson.social, an online space dedicated to the community of Nelson, BC! We’re excited to build a place where people from all walks of life can come together to share ideas and passions, build connections, or just hang out and chat.

Here at nelson.social, we believe in the power of community and the importance of supporting one another in order to enrich our community. Whether you are a lifelong resident of Nelson, new to the region, or just passing through, we invite you to join the conversation and be a part of our community.

In this space, you can share your thoughts and ideas, ask questions of your neighbours, and even plan events and activities. You can also connect with people from all over the world, because nelson.social is part of the Mastodon network. We like to think of it like a big WhatsApp or iMessage group, but where you can choose who to share with and whose messages you see, even if they aren’t members of nelson.social.

Goals

  1. Provide a safe and welcoming community space for discussing Nelson & area activities, news, events, and experiences
  2. Provide a venue for both casual and serious conversation, with the ability for users to opt-out of unwanted content
  3. Fun! We aim to foster a community of individuals and business that love being here in the Kootenays. We welcome personal posts, event notices and organizing

Non-Goals

nelson.social is not:

  • A money-making exercise. This is a community-run website, made of open-source software, hosted and moderated by volunteers who live in your community. We are not going to sell your data, or try to get you addicted so that we can show you more ads. In fact, there are no ads!
  • A "free speech" zone. We encourage authentic, curious, respectful conversation, including disagreement, but we do not tolerate all forms of speech. We do not tolerate hate speech of any kind. Bad-faith debating is equally unwelcome, as is misinformation.
  • A place for general advertisement. Promoting your original work is welcome, but please avoid overly commercial self-promotion

Land Acknowledgement

We respectfully acknowledge that in Nelson we live and work on the traditional, ancestral and unceded territory of the Ktunaxa Nation, Sinixt Nation, and Syilx Peoples. We feel privileged and grateful to be here, and we invite those reading this to explore their own relationship to place.

Code of Conduct

Nelson is home to people from all over the world who have a diverse set of skills, personalities, backgrounds and experiences. We are committed to ensuring that the nelson.social community is a safe, enjoyable and thriving environment for the largest number possible of Nelson residents, their friends and family members. We celebrate diversity and do not tolerate bigotry, prejudice or discrimination.

The Code of Conduct is a living document. If you have any questions, concerns, or suggestions, please contact [email protected].

We expect all community participants to abide by this Code of Conduct in all community venues-online and in-person as well as in all one-on-one communications pertaining to community business. This code of conduct and its related procedures also applies to unacceptable behavior occurring outside the scope of community activities when such behavior has the potential to adversely affect the safety and well-being of community members.

Encouraged Behavior

  • Be friendly, open and welcoming.
  • Participate in an authentic and active way. In doing so, you contribute to the health and longevity of this community
  • Exercise consideration and respect in your speech and actions.
  • Attempt collaboration & de-escalation before conflict.
  • If you inadvertently cause offence to someone else, take responsibility for your actions.
  • Refrain from demeaning, discriminatory, or harassing behavior and speech.
  • Be mindful of your fellow participants. Alert community leaders if you notice a dangerous situation, someone in distress, or violations of this Code of Conduct, even if they seem inconsequential.

Unacceptable Behavior

  • Illegal content.
  • Violence and incitement, including the use of violence, threats of violence or violent language directed against another person.
  • Discrimination, including the use of slurs or racist, sexist, homophobic, transphobic, ableist or otherwise discriminatory or hateful jokes or language.
  • Adult nudity and sexual activity, including the posting or display of sexually explicit or violent material, sexualized comments, or jokes.
  • Bulling and assessment, including doxing (posting or threatening to post other people's personally identifying information, personal insults, deliberate intimidation, stalking or following (online or in person).
  • Malware, e.g. knowingly or recklessly introducing a virus or other harmful component, or otherwise tampering with, impair or damage the nelson.social online place.
  • Tone policing and debating moderation actions in public. If you disagree with how a moderator enforced this Code of Conduct you may direct-message the moderation team. Messages you see on nelson.social may violate the standards of civility we set on nelson.social, but you should not criticize users for their tone. If the user is a member of the nelson.social community, you should report them; if not, you should feel free to block them. In neither case should you criticize their tone.
  • Advocating for, or encouraging, any of the above behavior.

Consequences of Unacceptable Behavior

Unacceptable behavior from any community member, including community organizer(s), will not be tolerated.

Anyone asked to stop unacceptable behavior is expected to comply immediately.

If a community member engages in unacceptable behavior, the community organizers may take any action they deem appropriate, up to and including a temporary suspension or permanent ban from the community without warning. In particular, we do not tolerate anyone deliberately or repeatedly breaking these rules.

Reporting Guidelines

If you are subject to or witness unacceptable behavior, please use the "Report user" functionality of Mastodon. If the situation is beyond unacceptable behavior, please notify any of the Team via direct message. Your reports will be taken seriously, treated in confidence and will not be dismissed or argued with. Additionally, community organizers are available to help community members engage with local law enforcement or to otherwise help those experiencing unacceptable behavior feel safe.

Addressing Grievances

If you feel you have been falsely or unfairly accused of violating this Code of Conduct, you should notify [email protected] with a concise description of your grievance. Your grievance will be handled in due course by the moderation team.

Minimum Age

The minimum age to use the nelson.social online space is 13 years old. By using this Site, you represent and warrant that you are at least 13 years old.

Passwords and Security

You agree that you will not share your account or account information with others. You are responsible for taking reasonable steps to maintain the confidentiality of your username and password, and you are responsible for all activities under your account that you can reasonably control.

Declaimers and Limitation on Liability

The nelson.social online space is provided “as is” and “as available.” We disclaim all conditions, representations and warranties not expressly set out in these terms to the fullest extent permitted by law.

We shall not be liable for delay or failure in performance for causes beyond our control or any other damage which does not result from a breach of our obligations under the Terms of Use.

We are not liable for business losses. We only provide the nelson.social online space for your personal, non-commercial, and domestic use. If you use our online space for any other purpose we will have no liability to you for any loss of profit, loss of business, business interruption, loss of business opportunity, or similar loss.

We are not responsible for any lack of functionality or failure to provide any part of the online place, or any loss of content or data that is due to: your equipment, devices, operating system or internet connection; or your failure to comply with specified compatibility requirements.

To the extent not prohibited by applicable law, we shall not be liable to you for indirect, incidental, special or consequential damages, including lost profits and property damage, even if we were advised of the possibility of such damages, nor shall we be held liable for delay or failure in performance resulting from causes beyond our reasonable control.

In no event shall our total liability to you for all damages, losses and causes of action exceed ten Canadian dollars (CAD $10).

User Generated Content

In connection with anything you submit to us – whether or not solicited by us – you agree that creative ideas, suggestions or other materials you submit are not being made in confidence or trust and that no confidential or fiduciary relationship is intended or created between you and us in any way, and that you have no expectation of review, compensation or consideration of any type.

We do not claim ownership of the content that you communicate, submit, upload or otherwise make available text, chats, images, audio, video, or other content in the nelson.social online space. Choice of Law

The Terms of Use are governed by and construed in accordance with the laws of the Province of British Columbia.

Waiver

No waiver of any provision of the Terms by us shall be deemed a further or continuing waiver of such provision or any other provision, and our failure to assert any right or provision under the Terms shall not constitute a waiver of such right or provision.

Severability

If any provision of the Terms shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from the rest of the Terms and shall not affect the validity and enforceability of any remaining provisions.

Disputes

Proceedings to resolve or litigate a dispute in any forum will be conducted on an individual basis to the fullest extent permitted by applicable law. Neither you nor us will seek to have a dispute heard as a class action or in any other proceeding in which either party acts or proposes to act in a representative capacity. No arbitration or proceeding can be combined with another without the prior written consent of all parties to the arbitrations or proceedings.

All disputes arising out of or in connection with the Terms of Use, or in respect of any legal relationship associated therewith or derived therefrom, shall be referred to and finally resolved by proceeding administered by the British Columbia Civil Resolution Tribunal.
